Terms of Service
Effective: October 15, 2026
1. Acceptance
These Terms of Service (“Terms”) form a binding agreement between you and Med.xyz governing your access to and use of the Med.xyz website, applications, and services (the “Service”). By creating an account or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. The Service is intended for use by adults capable of entering into a legally binding agreement. If you create an account on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. Wellness scope — not medical advice
The Service provides educational and wellness information only. Med.xyz is not a healthcare provider, does not practice medicine, and does not provide diagnoses, treatments, prescriptions, or medical advice. The MedQ Score, body-region findings, food sensitivity summaries, and AI-generated narratives are non-diagnostic interpretations of documents you upload, intended to support conversations with your own licensed healthcare professional.
Always seek the advice of a qualified healthcare provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you read or received from the Service. In an emergency, call 911 or your local emergency number.
4. Your account
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information and to update it as needed. We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to the Service or to other users.
5. Subscriptions and billing
Some features are offered on a paid subscription. Subscriptions are billed on a recurring basis through our payment processor. Unless cancelled before the next billing cycle, your subscription will automatically renew at the then-current rate. You may cancel at any time through your account settings or by contacting us at support@med.xyz. Except where required by law, fees already paid are non-refundable.
6. Acceptable use
You agree not to:
- Upload content that is unlawful, infringing, or that you do not have the right to share.
- Attempt to access another user's account or data, or any non-public area of the Service.
- Reverse engineer, scrape, or interfere with the Service, including by overloading, probing, or testing the vulnerability of the Service except under a written authorization.
- Use the Service to develop a competing product or to train a machine-learning model.
- Use the Service in violation of HIPAA, state health-data laws, or any other applicable law.
7. Your content
You retain ownership of the documents and information you upload (“Your Content”). You grant Med.xyz a limited, non-exclusive license to host, process, transmit, and display Your Content solely as needed to provide the Service to you and as described in Section 8. We do not claim ownership of Your Content and we do not use it to train general-purpose AI models.
8. How We Use Data, Including for AI
Med.xyz may create de-identified and aggregated statistics from information in Med.xyz and from how Med.xyz is used, combined across many users, so that they cannot reasonably be linked to any person, family, household or organization (“De-identified Data”). We may use De-identified Data to operate, measure, improve and develop Med.xyz, including its analytics and AI features, and Med.xyz owns it. We will not try to re-identify De-identified Data, and anyone we share it with must agree not to try either.
We never use personal information to train AI models. This includes health information, scans, lab results and other protected health information and anything else that identifies a person. Health information is de-identified only as permitted by HIPAA (45 C.F.R. § 164.514) before any aggregate use. We do not sell personal information or share it for cross-context behavioral advertising.
9. AI outputs
AI-generated outputs may be inaccurate, incomplete, or out of date. You are solely responsible for any decisions you make based on AI outputs. The Service does not replace consultation with a licensed clinician.
10. Termination
You may terminate your account at any time. We may suspend or terminate your access for violations of these Terms, for non-payment, or to comply with law. On termination, we will retain or delete your information in accordance with our Privacy Policy.
11. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT ANY OUTPUT WILL BE ACCURATE.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MED.XYZ AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, DATA, OR GOODWILL, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS.
13. Indemnification
You agree to indemnify and hold harmless Med.xyz and its affiliates from any third-party claim arising out of your violation of these Terms, your misuse of the Service, or your infringement of any third-party right.
14. Governing law and disputes
These Terms are governed by the laws of the State of Utah, without regard to conflict of laws principles. Any dispute will be resolved by binding arbitration administered by a recognized arbitration provider, except that either party may bring an individual action in small-claims court. You waive the right to participate in a class action or class arbitration to the extent permitted by law.
15. Changes
We may update these Terms. Material changes will be communicated via the Service or by email. Continued use after the changes take effect constitutes acceptance of the new Terms.
16. Contact
Questions about these Terms may be sent to support@med.xyz.
